Some Key Provisions of the Child Nutrition and WIC Reauthorization Legislation

Summer Food Service Program

   
Raise limit on number of sites non-profit organizations can operate, from 20 to 25, regardless of type of site (urban/rural); eliminate limit on total number of children that can be served.

Allow commercial or non-profit vendors to supply meals to private non-profit organization sponsors (currently restricted to self-preparation or using public vendors only). Y Y
Eliminate requirement that prohibits notifying private non-profits about summer food program eligibility before March 1.   Y
 

Child and Adult Care Food Program

   
Allow children between the ages of 12 and 18 participating in CACFP after school programs to receive free snacks in eligible areas (areas with 50% or more low income children). Y Y
Allow school operated, school-based after school programs to use the National School Lunch program to provide free snacks to children up to age 18. Y Y
Provide information about the WIC program to low-income families through CACFP centers and family child care homes. N Y
 

National School Lunch Program (NSLP) and School Breakfast Program (SBP)

   
Create a Universal School Breakfast pilot project, including an evaluation and report, for up to six school food service authorities. Y Y
Encourage schools to provide adequate meal time and a pleasant environment for children participating in school meal programs. N Y
Require that all schools participating in the School Breakfast and Lunch Programs, in which meals are prepared, to obtain semi-annual (annual in the Senate version) health and safety inspections covering their food service operations. Y Y
Require schools to purchase, whenever possible, food products that are produced in the United States. Y Y
 

WIC Program

   
Income documentation required for all participants, except at States' option in cases where information is not available, or when a barrier to participation exists, such as homelessness. Y Y
Verification of income documentation for WIC participants. X Y
Physical presence required at all visits, except at States' option for those with disability, health problems, or for recertification of a child with one or more working parents who has been present within the past year. Y Y
Allow WIC educational materials to be distributed (at WIC cost) to the Commodity Supplemental Food Program State Agencies. Y Y
Food funds may be used to purchase breast pumps, provided NSA funds equal to the amount spent in the previous year are spent first. Y Y
Vendors who traffic in food instruments, or sell firearms, ammunition, explosives or controlled substances in exchange for food instruments must be permanently disqualified, except where it would cause hardship to participants. (Additional exceptions in Senate bill for vendors with programs to prevent violations and where owner was unaware.) Y Y
Establishment of maximum fine for vendors and recipient fraud and abuse. Y Y
Request a study and report on the effect of WIC cost containment strategies. Y Y
Request the GAO to conduct a study and produce a report on the cost of WIC services. N Y
